Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Funktion Labs LLC (“Funktion Labs,” “we,” “us,” or “our”), the maker of the Solo cycling app (“Solo” or the “App”). By downloading, installing, or using Solo, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

Solo is not directed at children under 13. By using the App you confirm that you are at least 13 years old. If you are between 13 and the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Apple ID and iCloud Account

Solo does not have its own account system. Your data and any subscription you purchase are tied to the Apple ID you use on your device. We do not create, host, or manage user accounts, and we do not have access to your Apple ID credentials or the contents of your personal iCloud storage.

You are responsible for maintaining the security of your Apple ID and your device. Actions taken under your Apple ID — including purchases and data syncing through iCloud — are your responsibility.

3. License to Use Solo

Subject to these Terms, Funktion Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use Solo on Apple devices that you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved by Funktion Labs.

4. Subscriptions, Billing & Trials

Solo offers paid subscription plans, priced and billed through your Apple ID via the App Store:

  • Monthly plan — billed each month. No free trial is offered on the monthly plan.
  • Annual plan — billed once per year. A 14-day free trial is offered to eligible new subscribers; if you do not cancel before the trial ends, your Apple ID will be charged for the annual subscription.

Subscriptions auto-renew at the end of each billing period at the then-current price unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in the App Store subscription settings on your Apple device.

Family Sharing is not supported. A Solo subscription entitles only the Apple ID that purchased it. Attempting to share a subscription across Apple IDs may result in features being unavailable.

Prices and plan terms may change over time. Any changes to your existing subscription price will be communicated in advance as required by Apple and applicable law.

5. Refunds

All purchases and subscription payments are processed by Apple and are subject to Apple's refund policy. Funktion Labs does not process payments directly and cannot issue refunds. To request a refund, contact Apple Support at reportaproblem.apple.com.

6. Safety Disclaimer

Cycling is an inherently risky activity. Your safety is your responsibility. By using Solo you acknowledge and agree to the following:

  • Consult a qualified medical professional before starting or changing any exercise program. Solo is not a substitute for medical advice, diagnosis, or treatment.
  • Do not interact with your phone or Solo while riding. Always stop in a safe location before tapping, typing, or adjusting the App.
  • Always keep your attention on the road, your surroundings, and other road users. GPS, routing, and navigation provided by Solo may be inaccurate, delayed, or incomplete.
  • Obey all applicable traffic laws, signs, and signals. Follow local rules about helmets, lighting, and where cycling is permitted.
  • Suggested routes may include roads, conditions, or hazards that are unsuitable for your experience or equipment. You are solely responsible for evaluating whether any route is safe for you to ride.
  • Metrics such as distance, speed, elevation, heart rate, and calories are estimates and may contain errors. Do not rely on them for medical, emergency, or safety-critical decisions.

To the fullest extent permitted by law, Funktion Labs disclaims any liability for injury, loss, or damage arising from your use of Solo while cycling or otherwise.

7. Acceptable Use

You agree not to:

  • Use Solo in violation of any applicable law or regulation
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent expressly permitted by law
  • Modify, adapt, translate, or create derivative works based on the App
  • Remove, obscure, or alter any proprietary notices in the App
  • Use the App in any way that could damage, disable, overburden, or impair Apple's services on which Solo depends
  • Use the App to harass, harm, or infringe the rights of any other person

8. Your Content and Data

You retain all rights to the ride data, routes, photos, and other content you create in Solo. Because your data is stored on your device and in your personal iCloud account, Funktion Labs does not access or control it. You are responsible for your own backups and for any content you choose to export or share outside the App. See our Privacy Policy for more detail on how Solo handles your data.

9. Intellectual Property

The App, including its software, design, logos, trademarks, and copy, is owned by Funktion Labs and its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you. “Solo” and the Solo logo are trademarks of Funktion Labs LLC.

10. Third-Party Services

Solo relies on services provided by Apple (including MapKit, HealthKit, CloudKit, and StoreKit) and, where applicable, map and location data provided by Apple's suppliers. Your use of those services is also subject to their own terms. Funktion Labs is not responsible for the accuracy, availability, or performance of third-party services.

11. Disclaimer of Warranties

Solo is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Funktion Labs disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Funktion Labs does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any data, metric, map, or route provided by the App will be accurate or reliable.

12. Limitation of Liability

To the fullest extent permitted by law, in no event will Funktion Labs LLC, its members, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of Solo, even if advised of the possibility of such damages. Funktion Labs' total aggregate liability for any claim arising out of or relating to these Terms or the App will not exceed the greater of (a) the amounts you paid to Funktion Labs (through Apple) for Solo in the twelve (12) months preceding the event giving rise to the claim, or (b) twenty U.S. dollars ($20).

13. Indemnification

You agree to defend, indemnify, and hold harmless Funktion Labs LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any law or the rights of any third party.

14. Termination

These Terms remain in effect while you use Solo. You may stop using Solo at any time by uninstalling the App and canceling any active subscription in your App Store settings.

Funktion Labs may suspend, terminate, or modify Solo, or your access to it, at any time, for any reason, including if we reasonably believe you have violated these Terms. Sections that by their nature should survive termination (including Sections 8–13, 15, and 16) will survive.

15. Governing Law and Disputes

These Terms and any dispute arising out of or relating to them or the App will be governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and Funktion Labs agree that the state and federal courts located in California will have exclusive jurisdiction over any such dispute, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice in the App. Your continued use of Solo after changes take effect means you accept the updated Terms.

17. Apple-Specific Terms

You acknowledge that these Terms are between you and Funktion Labs LLC, not with Apple Inc. (“Apple”), and that Apple is not responsible for Solo or its content.

  • The license granted to you is limited to a non-transferable license to use Solo on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms.
  • Apple has no obligation to furnish any maintenance or support services for Solo.
  • In the event of any failure of Solo to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Solo.
  • Funktion Labs, not Apple, is responsible for addressing any claims relating to Solo, including product liability claims, claims of failure to conform to legal requirements, and claims under consumer protection or similar legislation.
  • Funktion Labs, not Apple, is responsible for investigating and resolving any third-party claim that Solo or your use of it infringes that third party's intellectual property rights.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as third-party beneficiaries.
